1. Definitions

In these General Terms and Conditions, the following definitions apply:

Customer: any natural or legal person placing an order via our website.

Products: physical goods offered for sale through our webshop.

Webshop: the online store operated under www.villanuevi.com.

Agreement: a legally binding purchase agreement between Villanuevi and the Customer.

Written: communication by email or postal mail.

2. Scope

2.1 These Terms and Conditions apply to all offers, orders, and agreements concluded via the webshop.
2.2 Deviations from these terms are only valid if expressly agreed upon in writing.
2.3 By placing an order, the Customer confirms acceptance of these Terms and Conditions.

3. Products and Pricing

3.1 All offers are non-binding and subject to availability.
3.2 Product images are for illustrative purposes and may differ slightly from the delivered item.
3.3 All prices are stated in EUR (or the selected currency), include VAT where applicable, and exclude shipping costs unless stated otherwise.
3.4 Villanuevi reserves the right to adjust prices and product information at any time.

4. Orders and Agreement

4.1 The Agreement is concluded once the Customer places an order and receives an order confirmation by email.
4.2 Villanuevi reserves the right to refuse or cancel orders in cases of suspected fraud or incorrect information.
4.3 The Customer is responsible for providing accurate and complete billing and delivery details.

5. Payment

5.1 Payment must be made in advance using the payment methods available at checkout.
5.2 Orders will only be dispatched after full payment has been received.
5.3 Chargebacks or unauthorized payment reversals may result in additional costs being charged to the Customer.

6. Shipping and Delivery

6.1 Orders are shipped from international warehouses. Estimated delivery time is 7–14 business days.
6.2 Delivery times are indicative and may vary due to customs procedures, public holidays, or unforeseen circumstances.
6.3 The risk of loss or damage transfers to the Customer once the order is handed over to the carrier.
6.4 Any customs duties or import taxes are the responsibility of the Customer.

7. Right of Withdrawal and Returns

7.1 Customers within the EU have the right to withdraw from the Agreement within 30 days of receiving the order.
7.2 After notifying Villanuevi of the withdrawal, the product must be returned within 14 days.
7.3 Refunds will be processed within 5 business days after receipt and inspection of the returned item, using the original payment method.
7.4 Returned items must be unused, undamaged, and in their original packaging.
7.5 Certain products, such as hygiene-related items, cannot be returned if the seal has been broken.

8. Warranty and Conformity

8.1 Villanuevi guarantees that products conform to their description and are free from manufacturing defects.
8.2 Any defects must be reported within 14 days of discovery.
8.3 The warranty does not apply in cases of:

Improper use or handling
Normal wear and tear
Unauthorized alterations or repairs

9. Liability

9.1 Villanuevi is not liable for indirect or consequential damages, including loss of profit or income.
9.2 Liability is limited to the total purchase amount of the affected order.
9.3 Villanuevi is not responsible for delays caused by third parties.

10. Force Majeure

10.1 In the event of force majeure (including natural disasters, strikes, or pandemics), Villanuevi’s obligations may be temporarily suspended.
10.2 If a force majeure situation persists for more than 30 days, either party may terminate the Agreement.

11. Complaints Procedure

11.1 Complaints must be submitted in writing to info@villanuevi.com.
11.2 Villanuevi aims to respond to complaints within 14 days of receipt.
11.3 If no satisfactory resolution is reached, the Customer may submit the dispute to the competent court.

12. Amendments

12.1 Villanuevi reserves the right to amend these Terms and Conditions at any time.
12.2 The most current version will always be available on www.villanuevi.com and applies to all new orders.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions are governed by Dutch law.
13.2 Any disputes shall be submitted to the competent court in Malta
